Impact of the FIDIC Contract Conditions on the Implementation of the Construction Projects in Poland

Abstract

Purpose – The main goal of the researchers is a detailed assessment of the impact of FIDIC Conditions of Contract (CoC) on the implementation of construction investments in Poland. FIDIC is a French language acronym for Fédération Internationale Des Ingénieurs-Conseils, which means the International Federation of Consulting Engineers. In order to assess the FIDIC CoC in detail, the researchers will ask the following research questions: 1) How do the FIDIC CoC influence the key parameters related to the performance of contracts (e.g. time, budget, detailed scope, etc.)?; 2) What are the benefits and threats of using the FIDIC CoC during the implementation of construction investments? 3) What are the most common deviations from the FIDIC Golden Principles? The main method used in this study is quantitative (survey questionnaire) and qualitative (standardized interview) studies.

Findings – On the basis of the conducted research, it can be concluded that the greatest advantages: more effective project management, easier dispute resolution, reducing the risk and increasing the quality of the work performer; and disadvantages which include: acting for the benefit of the Employer, increasing the involvement of resources (human and capital) and increasing the budget.

Originality/value – Research shows that the proper use of the FIDIC Contract Conditions during the implementation of construction investments in Poland may bring benefits for the Employer and the Contractor.
